This is an appeal by Mrs. Robert O. Wilson, defendant-landlady, from an adverse judgment rendered against her and in favor of her former tenant, William A. OConnor, based on TEX.REV.CIV.STAT.ANN.art. 5236e § 4 (Vernon Supp. 1976-77) after a trial before the court. Plaintiff OConnor sued Mrs. Wilson for a "bad-faith" failure to return his security deposit. Although the trial court made no finding with respect to "bad faith" on the part of Mrs. Wilson, it nevertheless rendered a judgment against her for treble the amount of the deposit plus $100 and attorneys fees, as authorized under section 4(a) of article 5236e for the "bad-faith" retention of a security deposit. Because we hold that the trial court erroneously construed this statute, we reverse and remand for a determination of bad faith.
